IMPORTANT NOTICE: By accessing, browsing, or using BankNifty Intelligence Hub (the “Platform”, “Service”, “Website”) operated at bankniftyintel.com, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must immediately cease all use of the Platform.

1. Definitions

  • “Company”, “We”, “Us”, “Our” refers to the owners, operators, developers, and administrators of bankniftyintel.com.
  • “Platform” refers to the BankNifty Intelligence Hub website, application, APIs, and all associated services located at bankniftyintel.com.
  • “User”, “You”, “Your” refers to any individual or entity accessing or using the Platform.
  • “Content” refers to all reports, analysis, data, scores, predictions, signals, text, graphics, and any other material generated, displayed, or made available through the Platform.
  • “Generated Reports” means any AI-generated intelligence reports, bias scores, predictions, signals, or analysis produced by the Platform.
  • “Credits” means the digital tokens purchased by Users to access report generation features of the Platform.

2. Nature of Service

BankNifty Intelligence Hub is a technology platform that aggregates publicly available market data from various sources and uses artificial intelligence models to generate analytical reports. We are NOT:

  • Registered with SEBI (Securities and Exchange Board of India) as an investment advisor, research analyst, portfolio manager, or in any other capacity.
  • A financial advisor, stock broker, investment bank, or wealth manager.
  • A guarantor, insurer, or underwriter of any financial investment or return.
  • Providing personalized or customized financial advice to any individual or entity.

All Content generated on this Platform is for informational and educational purposes only and must not be construed as financial advice, investment recommendations, or solicitation to buy, sell, or hold any securities or derivatives.

3. Eligibility

You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you are legally capable of entering into binding contracts and that your use complies with all applicable laws and regulations.

4. User Accounts & Access

  • Access to certain features requires registration and authentication via approved credentials.
  • You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • We reserve the absolute right to suspend, terminate, or restrict any account at any time, for any reason, without prior notice or liability.
  • Sharing account credentials, reselling access, or unauthorized redistribution of Platform Content is strictly prohibited and grounds for immediate termination.

5. Credits & Payments

  • All credit purchases are final and non-refundable unless explicitly authorized by the Company in writing.
  • Credits have no cash value and cannot be redeemed, transferred, or exchanged for monetary value.
  • Credits may expire as determined by the Company at its sole discretion.
  • The Company reserves the right to modify credit pricing, packages, and the credit cost of services at any time without prior notice.
  • In the event of a technical failure during report generation where credits are deducted, the Company may, at its sole discretion, restore credits. This is not an obligation.

6. Intellectual Property & Content Ownership

CRITICAL CLAUSE: All Content generated through the Platform, including but not limited to AI reports, bias scores, predictions, signals, executive summaries, data analyses, and any derivative works thereof, are the exclusive intellectual property of the Company. By using the Platform and generating any Content, you irrevocably assign, transfer, and convey all right, title, and interest in and to such Content to the Company.

  • The Company retains full, perpetual, irrevocable, worldwide, royalty-free rights to use, reproduce, modify, distribute, display, license, sublicense, sell, or otherwise exploit any and all Generated Reports and Content for any purpose, including but not limited to commercial use, marketing, training AI models, research, publication, or distribution to third parties.
  • Users are granted a limited, non-exclusive, non-transferable, revocable license to view and use Generated Reports for their own personal, non-commercial reference only.
  • Users may not reproduce, republish, distribute, sell, license, or publicly display any Content from the Platform without prior written consent from the Company.
  • The Platform’s source code, design, trade dress, logos, branding, algorithms, and proprietary scoring methodology are proprietary to the Company and protected under applicable intellectual property laws.

7. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. The Company expressly disclaims all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, completeness, or timeliness.
  • Any warranties arising from course of dealing, usage, or trade practice.
  • Any warranty that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS OWNERS, OPERATORS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY:

  • Direct, indirect, incidental, special, consequential, punitive, or exemplary damages of any kind.
  • Loss of profits, revenue, data, goodwill, business opportunities, or anticipated savings.
  • Financial losses, investment losses, or trading losses of any nature.
  • Damages arising from reliance on any Content, report, prediction, signal, or analysis provided by the Platform.
  • Damages arising from service interruptions, data inaccuracy, system failures, or third-party data source errors.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if the Company has been advised of the possibility of such damages. In no event shall the Company’s total aggregate liability exceed the amount paid by the User to the Company in the thirty (30) days preceding the event giving rise to the claim, or INR 1,000 (Indian Rupees One Thousand), whichever is less.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its owners, operators, directors, employees, agents, affiliates, and licensors from and against all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use or misuse of the Platform or any Content.
  • Any trading, investment, or financial decisions you make based on or influenced by Content from the Platform.
  • Your violation of these Terms or any applicable law or regulation.
  • Your violation of any rights of any third party.
  • Any claim by any third party arising out of your use of the Platform.

10. Assumption of Risk

By using this Platform, you expressly acknowledge and accept that:

  • Trading in securities, derivatives, options, and futures carries substantial risk of financial loss, including the potential loss of your entire investment.
  • AI-generated predictions, scores, and signals are probabilistic estimates and not guarantees of future market movements.
  • Past performance, historical data, or AI-generated analysis does not guarantee or predict future results.
  • You are solely responsible for all your trading and investment decisions and their financial consequences.
  • Market conditions can change rapidly and unpredictably after any report is generated.

11. Third-Party Data & Services

The Platform aggregates data from third-party sources including but not limited to NSE, BSE, Yahoo Finance, Google News, Reuters, RBI, PIB, SEBI, and various news outlets. We do not control, endorse, or guarantee the accuracy, completeness, or reliability of any third-party data. The Company shall not be liable for any errors, omissions, or inaccuracies in third-party data.

12. AI Models & Third-Party APIs

The Platform utilizes third-party AI model providers (such as Google Gemini, OpenAI, Anthropic, xAI, and OpenRouter) for report generation. The Company does not control these AI models and is not responsible for the accuracy, biases, errors, or limitations of AI-generated output. AI model availability may change without notice.

13. Modification of Terms

The Company reserves the right to modify, amend, or replace these Terms at any time at its sole discretion. Changes will be effective immediately upon posting. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

14. Termination

The Company may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including but not limited to breach of these Terms. Upon termination, your right to use the Platform ceases immediately. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, limitation of liability, and indemnification.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in New Delhi, India. You irrevocably waive any objection to the venue or jurisdiction of such courts.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

17. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and the Company regarding the use of the Platform and supersede all prior agreements, understandings, and communications.
